Offers are to be submitted to Hilco Real Estate as soon as possible. The subject properties are all in the U.S. Bankruptcy Court of the Southern District of Florida and sales are subject to court approval.
Process to submit an offer:
1) Submit your offer on the approved Asset Purchase Agreement located in our data room.
2) Include a 10% earnest money deposit with your offer, wiring instructions are in our data room, your earnest money is non-refundable if you are the final purchaser.
3) Include proof of funds or a noncontingent bank letter showing immediately available funds to complete the transaction.
All offers will immediately be reviewed with the Chief Restructuring Officer for this case to determine if they qualify for presentation to the bankruptcy court. Once qualified, your offer will be published and made subject to higher and better offers as part of the court ordered sale process. You will receive protections for being the first qualified offer such as, a small breakup fee if you are out bid, limited input on the bidding procedures, and the ability to over bid if you choose. All final purchasers will get clean title, free and clear of all liens.
Note: Offers can be made on multiple properties within Portfolio 1 or multiple properties within Portfolio 2, offers can not be made for multiple properties across the two portfolios. If you have interest in properties in both portfolio’s they will need to be submitted on separate Asset Purchase Agreements. Also, if an offer is placed on multiple properties within a portfolio, your offer will need to specify a price for each property within the Asset Purchase Agreement.
